1. Acceptance of These Terms

These Terms and Conditions ("Terms") govern your access to and use of Evolve and Elevate, operated by Evolve and Elevate Media Development, including our websites, mobile experiences, applications, content, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and Accounts

You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you represent that a parent or legal guardian has authorized your use. You agree to provide accurate account information, protect your credentials, and promptly notify us of unauthorized access. You are responsible for activity conducted through your account.

3. Fitness, Nutrition, and Wellness Disclaimer

Workouts, exercises, plans, recipes, nutrition information, generated recommendations, trainer content, and progress estimates are provided for general informational and educational purposes. They are not medical advice, diagnosis, treatment, physical therapy, or a substitute for advice from a qualified health professional.

Exercise and dietary changes involve risk. Consult an appropriate professional before beginning a program, especially if you have an injury, medical condition, dietary restriction, are pregnant, or have other health concerns. Use proper equipment and technique, work within your abilities, and stop immediately if you experience pain, dizziness, faintness, or unusual symptoms. You assume the risks associated with your voluntary participation.

4. Trainers and Other Users

Trainers, nutrition professionals, creators, and other users are responsible for their own statements, qualifications, content, and conduct. A profile label or relationship in the Services does not by itself constitute our certification, employment, endorsement, or guarantee. Use your judgment before relying on another user or entering a training arrangement.

5. User Content and Social Features

You retain ownership of photos, videos, recipes, workouts, plans, messages, music or lyric content, profile information, and other material you submit ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute User Content only as reasonably necessary to operate, secure, improve, and provide the Services according to your actions and visibility choices. This license ends when the content is deleted, except for reasonable backups, legal retention, and copies previously shared with others.

You represent that you have the rights needed to submit User Content and that it does not violate law or another person's rights. Public posts and profile information may be viewed, saved, or reshared by others. We may remove content or limit accounts when reasonably necessary to enforce these Terms or protect the Services and our users.

6. Acceptable Use

You may not use the Services to:

• Break the law, infringe rights, threaten, harass, exploit, or impersonate another person.
• Post unlawful, deceptive, hateful, sexually exploitative, or dangerous content.
• Send spam, scrape data, misuse messages, or collect information without authorization.
• Upload malware or interfere with the security, availability, or operation of the Services.
• Access another account, bypass restrictions, or reverse engineer the Services except where law permits.
• Use automated output as professional medical, nutrition, legal, or financial advice.

7. Financial Planning Features

Any portfolio, market, dividend, retirement, or forecast information available through the Services is for general informational and planning purposes only. It is not investment, tax, legal, or accounting advice and is not an offer or recommendation to buy or sell a security. Market data and projections may be delayed, estimated, incomplete, or inaccurate, and future results are not guaranteed. Consult a qualified professional before making financial decisions.

8. SMS/Text Message Terms

Program and message types

The Evolve and Elevate Alerts program provides recurring transactional text messages concerning account or security notices, workout reminders, plan or trainer invitations, alerts that an in-app training message is waiting, service updates, and customer care. Marketing messages, if ever offered, require a separate express written opt-in that identifies that purpose.

Consent

By providing your mobile number through a separate SMS opt-in, you authorize Evolve and Elevate to send messages for the disclosed program using automated technology where applicable. Consent is not a condition of purchase or use of the Services. Creating an account or accepting these general Terms, without a separate SMS opt-in, does not enroll you in text messages. You represent that you are the subscriber or customary user of the number provided and will notify us if it changes. See our SMS Consent disclosure for the complete opt-in terms.

Frequency and charges

Message frequency varies based on account activity and notification preferences. Message and data rates may apply.Your mobile carrier's terms and rates govern your plan.

Opt-out and help

Reply STOP to unsubscribe at any time. You may receive one final confirmation message. Reply HELP for help or email fate@evolveelevatemedia.com. After an opt-out, we will not send additional messages unless you later provide a new valid opt-in.

Delivery and privacy

Carriers are not liable for delayed or undelivered messages, and delivery is not guaranteed. Our handling of mobile numbers and consent records is described in the Privacy Policy. We do not share, sell, rent, or otherwise provide mobile phone numbers or SMS consent information to third parties or affiliates for marketing or promotional purposes.

9. Affiliate Links and Third-Party Services

The Services may include links to equipment, products, music platforms, or other third-party services. Some links may be affiliate links, which means we may earn a commission from a qualifying purchase without changing your purchase price. We do not control and are not responsible for third-party products, content, availability, safety, pricing, or policies. Your dealings with a third party are between you and that party.

10. Intellectual Property

The Services, excluding User Content, and their software, branding, designs, text, graphics, and other materials are owned by or licensed to Evolve and Elevate Media Development and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, lawful use.

11. Service Changes and Account Termination

We may add, change, suspend, or discontinue features and may establish reasonable usage limits. You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary for security, legal compliance, nonpayment where applicable, repeated infringement, or a violation of these Terms. Provisions that by their nature should survive termination will survive.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not guarantee uninterrupted access, specific fitness or financial results, content accuracy, or that all errors will be fixed. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, Evolve and Elevate Media Development and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from the Services. Nothing in these Terms limits liability that cannot legally be limited.

14. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on this page with a revised effective date. When required, we will provide additional notice. Your continued use after an update becomes effective means you accept the revised Terms.
