Privacy Policy

How Evolve and Elevate collects, uses, protects, and shares information across its fitness, nutrition, social, creative, and communication features.

1. Scope

This Privacy Policy explains how Evolve and Elevate, operated by Evolve and Elevate Media Development ("Evolve and Elevate," "we," "us," or "our"), handles information when you use our websites, mobile experiences, applications, and related services (collectively, the "Services").

2. Information We Collect

Depending on how you use the Services, we may collect:

  • Account and profile information: name, username, email address, password credentials in protected form, birthday or age, biography, profile images, theme, time zone, and account preferences.
  • Fitness and wellness information: height, weight, gender, fitness level, goals, dietary preferences, equipment, workout locations, exercises, workout plans, schedules, logged sets, repetitions, weight used, progress, and notes you choose to provide.
  • Content and social activity: photos, videos, recipes, exercise and workout content, profile follows, likes, saves, shares, invitations, trainer-client relationships, in-app messages, and other content or interactions.
  • Optional planning and creative information: portfolio and financial-planning inputs, music-library information, lyrics, song ideas, and files you choose to use with available finance or music features.
  • Communications: messages sent to support, notification preferences, and, if you separately opt in to text messaging, your mobile number and SMS consent records.
  • Device and usage information: IP address, browser and device type, operating system, app or page activity, referring page, approximate location derived from IP address, diagnostics, crash information, and cookie or local-storage identifiers.

3. How We Use Information

We may use information to:

  • Create, authenticate, maintain, and secure your account.
  • Provide workouts, plans, schedules, progress tracking, recipes, equipment, and recommendations.
  • Operate profiles, feeds, follows, trainer-client tools, messages, shares, and invitations.
  • Store and display content according to your selections and applicable visibility settings.
  • Deliver notifications and respond to support or safety requests.
  • Personalize, analyze, troubleshoot, and improve the Services.
  • Prevent fraud, abuse, security incidents, and violations of our Terms and Conditions.
  • Comply with law and protect our users, Services, and legal rights.

4. Mobile Information and SMS Messaging

If you provide a mobile number and separately opt in to the Evolve and Elevate Alerts program, we may send recurring transactional text messages concerning account or security notices, workout reminders, plan or trainer invitations, notifications that you received an in-app training message, service updates, and customer care. Message frequency variesbased on your account activity and notification preferences. Message and data rates may apply.

Reply STOP to unsubscribe. You may receive one final message confirming your opt-out. Reply HELP for help or email fate@evolveelevatemedia.com. Consent to receive text messages is not a condition of purchase or use of the Services. Agreeing to the general site terms or creating an account, without a separate SMS opt-in, does not enroll you in text messages. We do not share, sell, rent, or otherwise provide your mobile phone number, SMS opt-in data, or messaging consent information to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

We may use communications providers solely to deliver and support the messaging program. Those providers may process mobile information only to perform services for us and may not use it for their own marketing or promotional purposes.

5. Public and Social Information

Your username, profile image, biography, follower information, and content you make public may be visible to other users or visitors. Content shared with another user, trainer, client, plan, or feed audience is available to those recipients. Review your settings and avoid posting information you do not want others to see or save.

6. How We Disclose Information

We may disclose information in the following limited circumstances:

  • Service providers: vendors supporting cloud hosting, file storage, analytics, communications, security, customer support, and application operations, subject to appropriate restrictions.
  • At your direction: when you post publicly, share a workout or plan, message another user, join a training relationship, or otherwise direct us to disclose information.
  • Legal and safety reasons: when reasonably necessary to comply with law, enforce our terms, protect rights or safety, or investigate fraud, abuse, or security issues.
  • Business changes: in connection with a merger, financing, acquisition, reorganization, or sale of assets, subject to applicable law.

We do not sell personal information for money. The mobile-number and SMS-consent restrictions in Section 4 apply regardless of the other disclosures described here.

7. Analytics, Cookies, and Local Storage

We use cookies, local storage, and similar technologies for authentication, preferences, security, and app functionality. We may use analytics and performance services, including Vercel Analytics and Speed Insights, to understand aggregate usage and improve reliability. Browser or device settings may let you limit these technologies, but parts of the Services may then work incorrectly.

8. Third-Party Services and Affiliate Links

The Services may link to music services, equipment sellers, affiliate offers, or other third-party websites and services. If you follow a link or use a third-party service, that provider handles information under its own terms and privacy policy. We may receive a commission from qualifying affiliate purchases, but that does not change the price you pay.

9. Data Retention and Security

We retain information for as long as reasonably necessary to provide the Services, maintain business and security records, resolve disputes, and meet legal obligations. Retention periods vary by data type and account status. We use reasonable administrative, technical, and organizational safeguards, but no internet transmission or storage system can be guaranteed completely secure.

10. Your Choices and Rights

You may update certain profile and notification settings in the Services. You may request access, correction, or deletion of personal information by contacting us, subject to identity verification and legal exceptions. Depending on where you live, you may have additional privacy rights. You can opt out of SMS messages at any time by replying STOP.

11. Children's Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, please contact us so we can review and address the request.

12. Changes to This Policy

We may update this Privacy Policy periodically. We will post the revised policy on this page and update the effective date. We may provide additional notice when required by law or when changes are material.
